These Terms of Service ("Terms") govern your access to and use of CryptoNow ("CryptoNow", "we", "us", "our"), the website at https://cryptnow.io (the "Site"), and any related services, APIs, payment pages, documentation, software, and webhooks (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

1. Description of Services

CryptoNow provides a non-custodial cryptocurrency payment gateway that enables merchants to accept payments in USDC and SOL on the Solana network. We provide payment pages, APIs, webhooks, account tools, and related infrastructure to facilitate payments.

CryptoNow is a technical service provider. We do not hold, store, or control customer or merchant funds. Payments are sent directly from the customer to the merchant wallet. CryptoNow receives its fee as a separate transfer inside the payment flow.

2. Eligibility

By using the Services, you confirm that you are legally able to enter into these Terms, that you are not prohibited from using the Services under applicable law, and that you will comply with all laws, sanctions rules, and regulations applicable to your use of the Services.

3. Accounts and Security

If you create an account, you must provide accurate and complete information and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4. Non-Custodial Nature, Transaction Finality, and Timers

CryptoNow does not custody funds. Once a blockchain transaction is confirmed according to the rules of the relevant network, it is final and irreversible. CryptoNow does not provide chargebacks or reversals.

The customer must complete payment only within an active payment session and before the timer displayed on the payment page expires.

Payments sent after session expiration or outside an active session may not be credited automatically and may be irreversibly lost.

CryptoNow is not liable for losses, delays, non-crediting, or loss of funds caused by payment after session expiration, payment via an invalid link, payment to an incorrect address, or payment outside the conditions of an active session.

After a payment has been submitted from the customer wallet, confirmation may take additional time due to blockchain processing and required confirmations. If funds have already been sent from the wallet, the customer must wait for confirmation and must not attempt to pay the same session again unless expressly instructed by CryptoNow. CryptoNow is not responsible for duplicate payments initiated after the original payment has already been broadcast from the customer wallet.

5. Fees

CryptoNow charges a commission for processing payments. Current pricing is displayed on the Site or in the Services.

As of the Effective Date, fees are: - $0.01 for payments up to $1.99 - $0.02 at $2.00, $0.03 at $3.00, and so on see details (Read Here).

For SOL payments, when the customer pays with SOL on the Solana network, the final SOL amount is calculated from a SOL/USD quote obtained from third-party providers and, when needed, from the service internal cache. Once the quote is locked, it is not recalculated for that session. We do not guarantee absolute quote accuracy, continuous quote-source availability, uninterrupted availability of SOL payments, or that a quote will always be available when a payment attempt starts. 6. Merchant Responsibilities

Merchants are solely responsible for the goods or services they offer, customer support, refunds, taxes, accounting, statements made to customers, and compliance with all applicable laws and regulations. CryptoNow does not provide refunds and does not resolve disputes between merchants and customers.

Merchants must ensure that wallet addresses, payout settings, webhook targets, API credentials, and all payment-related configuration are accurate and secure. CryptoNow is not responsible for merchant-side misconfiguration, merchant infrastructure failures, or compromise of merchant-controlled systems.

7. Customer Responsibilities

Customers are responsible for checking the payment details and the transaction they approve in their wallet, including the amount, currency, network, recipient addresses, and fees, before initiating a payment.

8. Prohibited Activities

You may not use the Services for illegal activities or to facilitate unlawful conduct. Without limiting the foregoing, you agree not to use the Services for:
- Fraud, scams, deceptive practices, chargeback abuse, or payment manipulation
- Malware, hacking, unauthorized access, credential attacks, or attacks against the Services or third parties
- Sale of illegal goods or services, including drugs or controlled substances, weapons or ammunition, child sexual abuse material or exploitation content, extremist or terrorist content, counterfeit or forged documents, and Ponzi schemes or similar fraud
- Activities that violate the rights of others, sanctions restrictions, anti-money-laundering rules, or other applicable law

We may suspend, restrict, or terminate access to the Services if we reasonably believe the Services are being used for prohibited activities.

9. Service Availability

The Services are provided on an "as is" and "as available" basis. CryptoNow does not guarantee uninterrupted operation of all features, integrations, data providers, or network infrastructure. Certain functions, including SOL payments, may be temporarily unavailable due to maintenance, protection, diagnostics, third-party service outages, risk controls, or blockchain conditions.

CryptoNow depends on third-party wallets, blockchain networks, RPC providers, market data providers, hosting, email providers, and other external infrastructure. CryptoNow is not responsible for outages, delays, inaccurate data, or failures caused by these third parties.

10. Limitation of Liability

To the maximum extent permitted by law, CryptoNow is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business, or goodwill. CryptoNow is not responsible for losses caused by blockchain network delays, congestion, protocol changes, third-party wallet issues, incorrect addresses, merchant misconfiguration, customer mistakes, sanctions screening, risk controls, or other factors outside our reasonable control.

11. Intellectual Property

All content and software provided by CryptoNow are owned by CryptoNow or its licensors. You may not copy, modify, distribute, reverse engineer, or create derivative works from them except as allowed by applicable law.

12. Termination

We may suspend, restrict, or terminate access to the Services at any time, with or without notice, if you violate these Terms or if we determine it is necessary to protect the Services, users, merchants, customers, third parties, or our legitimate interests.

13. Referral Program and Referral Payout Requests

CryptoNow has a referral program. Every registered user gets a standard 30% referral share from CryptoNow's service fee on successful payments. The referral share is calculated from CryptoNow's fee, not from the full payment amount paid by the customer.

CryptoNow may also offer an increased referral share of up to 70% to selected partners. This is partner status, not an automatic upgrade for every user. To be considered, a user must refer at least one merchant who completes a valid successful payment through CryptoNow, either through the API or the dashboard.

Meeting the minimum condition does not guarantee partner status. CryptoNow reviews partner requests individually and looks at referral quality, merchant activity, business fit, fraud risk, self-referrals, fake activity, misleading promotion, and compliance with these Terms. CryptoNow may update referral terms, referral percentages, partner conditions, or payout rules for future activity. Referral rewards already accrued before a Terms update will not be reduced retroactively.

Referral payout requests are reviewed manually and may only be requested once the minimum payout threshold displayed in the Services has been reached. When submitting a payout request, you must provide a valid Solana wallet address that you control. CryptoNow may reject, delay, request additional review for, or hold a payout request if the provided data is invalid, inconsistent, suspicious, abusive, or requires compliance or risk review.

If you register through a referral link and verify your email, the referrer will be able to see limited referral-program data related to your account, such as your displayed name, a masked email address, your referral status, join date, payment counts, and referral earnings generated through your successful payments.

14. Applicable Law and Interpretation

These Terms are intended to be interpreted to the maximum extent permitted by applicable law. Where mandatory law gives you rights that cannot be waived, those rights remain unaffected. Any dispute related to the Services will be handled in the forum and under the law required or permitted by the applicable law for the operator of the Services, unless mandatory law requires a different forum or rule.

15. Changes to These Terms

We may update these Terms at any time by posting a revised version on the Site. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
